NEW ASSURED SHORTHOLD TENANCIES (ASTs) SIGNED ON OR AFTER 1 JUNE 2019
Holding Deposit (per tenancy):
A Holding Deposit will be taken to reserve a property while pre-tenancy checks and references are taken. The amount will not be greater than one weeks rent. This sum will be transferred to become part of the Security Deposit when the tenancy is entered into. Please Note: This will be withheld if any relevant person withdraw from the tenancy, fail a Right to Rent check, provide significant false or misleading information, or fail to sign their tenancy agreement within the agreed timescale – usually 15 days – unless otherwise agreed in writing.
Security Deposit:
This covers damages or defaults on the part of the tenant during the tenancy. The figure is stated in the tenancy agreement and will be no greater than 5 weeks rent where the annual rent is less than £50,000 pa. - Five week's rent. Where the rent is £50,000 per annum, or more the deposit will be no greater than 6 weeks rent.
Unpaid Rent:
Interest on rents arrears will be charged at 3% above the Bank of England Base Rate from Rent Due Date until paid in order to pursue non-payment of rent. Please Note: This will not be levied until the rent is more than 14 days in arrears.
Loss or Damage of Keys and Any Other Security Devices:
Tenants are liable to the actual cost of replacing any keys or other security devices they lose or damaged. If the loss results in locks needing to be changed, the actual costs of a locksmith, new lock and the replacement of all keys for the tenant(s), landlord or any other persons requiring keys will be charged to the tenant. If extra costs are incurred there will be a charged at the rate charged by the contractor.
Variation of Contract:
The fee of £50 (inc. VAT) applies to each agreed variation requested by the tenant. This is to cover the costs associated with taking a landlord's instructions as well as the preparation and execution of new legal documents.
Notice is Received During a Fixed Term:
Where a tenant seeks to leave an agreement before the end of the agreed fixed term they will be responsible for the full balance of rent due until a suitable replacement is found. In such a situation the tenant will pay the lower of rent due for the remainder of the fixed term or the landlords costs associated with reletting the property.
